Misinterpretation of MACP Scheme.
Sir,
Some of the Comrades of AIPAEA have brought to my notice that the date of effect of their financial up gradation have been
deferred equal to the number of days
they have participated in Strike.
2. The
some of the relevant rulings for
grant of financial up-gradation
are as under:-
As per
the provision of para-9 of Annexure attached with O.M.No. 4-7/(MACPS)/2009-PCC
dtd. 18.9.2009, Regular service for the purpose of MACPS shall commence from the date of
joining of a post in direct entry grade on regular basis either on
direct recruitment basis or on absorption /re-employment basis.
3. Treatment of strike period for ACP
Scheme has been clarified at point No. 49 of
Deptt. of Personnel and Training O.M. NO. 35034/1/97-Estt(D) (Vol.IV)
dtd. 18.7.2001 is given below ( Photo copy enclosed).

Whether
any period(s) of break in service under FR-17-A declared during the career of
an employee will have any adverse effect on his getting financial up
gradation under the ACP Scheme?

Break
in service under FR-17 A incurs only 3
specific disabilities as specified in the relevant FR. It does
not affect the normal regular
promotions. Consequently, it will have no effect on financial up gradation
under the ACP Scheme.

4. The financial up gradation under
MACP Scheme is a modification of ACP Scheme. Clarifications issued by DOP&T
in connection with ACP Scheme will applicable in case of MACP Scheme.
5. The MACP Scheme is emphasizing
on commencement of regular Service on direct entry grade. There
is no rule in MACP Scheme for deferring the date of effect on the ground of participation in Strike/unauthorized absence.
In view of above, it is requested to kindly re-examine
the financial upgradation of Comrades in
whose cases date of effect have been
deferred with reference to proper interpretation of MACP Scheme. With instruction for issue of
modified order.
